2. Protection des données à caractère personnel |

In accordance with the modified Law n°78-17 of January, 6th 1978 regarding information technology, files and liberties, the automated processing of personal data implemented as part of the RTE Post'nGo website have been declared to the French Data Protection Authority (CNIL) on March, 20th 2014 under no 175 2109. They are listed in the files register.
In particular, the user is informed that, in accordance with the article 27 of the Law of January, 6th 1978, the personal information she/he voluntarily provide, by filling in forms on the portal, is intended for RTE.
Personal data collected through this website are subject to data processing under the responsibility of RTE as editor of the RTE Post'nGo website.
The user accepts that these data are used and/or disclosed to manage operations made on the website, by RTE.
RTE informs users of the RTE Post'nGo website that it respects the confidentiality, integrity and security of the data they would need to disclose through this site.
In accordance with Law n°78-17 of January, 6th 1978 regarding information technology, files and liberties, every person has a right of access, modification, rectification and deletion on any personal data about her/him.
Thus, any person may require rectifying, completing, updating or deleting information about her/him, she/he considers as inaccurate, incomplete, ambiguous, outdated or whose collection, use, disclosure or storage is prohibited.

3. Compliance with legislation |
|
RTE informs users that all applicable laws and regulations have to be respected by the RTE Post'nGo website.
The user agrees to comply with all applicable laws and regulations, particularly those regarding information technology, files, liberties and intellectual property as well as the rights of third parties (image right, privacy right...). Thus she/he ensures that data she/he or authorized users stored comply with these measures.
The user remains the only owner of the data and files transferred and/or stored on the website.
The user undertakes not to transfer, store, copy, share data for which she/he would not have all of the rights or at least the right holders' permission.
RTE reminds the user that the service is not intended to be used for massive file sharing. Thus RTE reserves the right to implement measures to control the proper use of the service by the user.
The user undertakes not to store and/or share illegal or damaging content, that can undermine public order or morality principles, in particular messages that can be qualified as abusive, insulting, derogatory, degrading, xenophobic, incentives to racial hatred, Holocaust deniers, revisionists, violent, obscene, defamatory, child pornographic, pornographic, or that could encourage hatred or harassment and would violate the right to privacy or without any connection with the proposed topics.
Furthermore, the user agrees not to transmit by any means whatsoever any content including programs, codes, viruses, etc. intended to destroy or limit the functionalities of the site.
In addition, users are required to comply with the measures of the Law of January, 6th 1978 regarding information technology, files and liberties, whose violation is punishable by law (criminal penalties).
Regarding personal data they access, they also must refrain from any collection or misuse, and in general, any act likely to affect the privacy or reputation of individuals.

4. Terms of use |
|
The use of Post'nGo service is subject to a full acceptance of these legal notices, on the principle of the user's free and informed consent, for any file sent on RTE servers.
Data stored within the application are kept for 30 days since they are made available. They will be automatically removed beyond that period.
Under the rules of IS use, the user is warned that the use of this service is tracked for security purposes and that uploaded files may be consulted.
Regarding RTE interactive services, RTE reserves the right to remove immediately and without prior notice, any content of any nature whatsoever, and in particular any message, text, image, graphic, etc... that would violate applicable laws and regulations especially regulations described above.
RTE cannot be held liable for direct or indirect damages that may result from the access or use of the website, including inaccessibility, loss of data, deteriorations, destructions or viruses that may affect user's computer equipment.
The user agrees to ensure successful files transmissions. RTE declines any responsibility in case of failure during a file transfer or download. It is up to the user to take all necessary measures to ensure that an uploaded file is effectively stored on the application and that this file is not compromised or altered. Similarly, the user accepts she/he may require transfering again a file if its previous transfer was interrupted.
The user is liable for the respect of these conditions by users with whom she/he exchanges data.

5. Intellectual property |
|
Any representation, modification, publication, transmission, alteration of the site or its contents, either total or partial and by any means, and on any media whatsoever, is prohibited without prior written permission from RTE. Any unauthorized use of the site, its contents, or the use of information disclosed therein would engage user's responsibility and constitute a punishable counterfeiting under intellectual property.
Any total or partial reproduction of the site contents is strictly prohibited without prior written permission from RTE. Therefore, any unauthorized reproduction or extraction would engage user's responsibility.
RTE brands and logos that appear on the site are protected. Any total or partial reproduction or representation of these marks or logos, alone or mixed with other elements, is prohibited without prior written permission from RTE and would engage user's responsibility as defined in articles L 713 -2 and L 713-3 of the Intellectual Property Code.

6. Cookie |
|
The user is informed that while she/he is using the website, a cookie may be automatically installed on her/his browser.
A cookie is an amount of data that does not allow to identify the user but is used to record information about her/his navigation on the site. The purposes of these cookies are to analyze the website traffic, measure the audience etc. to improve the quality of the website.
The user personal information are intended for RTE and may be communicated to third parties. Users can object to this transmission of information by sending an email to the site administrator.

7. Login and password management |

Some interactive services on the RTE "Post'nGo" website may require a login and password provided during the online registration process.
Logins and passwords are confidential, personal, non-assignable and non-transferable.
The user is responsible for the management and conservation of her/his logins and passwords. Consequently, it is up to the user to take all necessary measures for their protection and conservation. The user is responsible for the consequences of their use.
Under any circumstances, RTE cannot be held responsible for any fraudulent use of users' logins and passwords.
The user agrees to inform RTE, should she/he notice any fraudulent use of her/his logins and passwords.
RTE reserves the right to suspend the access to the website in case of fraudulent use or attempted fraudulent use of a user's password or login. In case of access suspension, RTE will inform the user.

8. Data security |
|
Data security is left to users' responsibility. In particular, if a user wants to share information not freely accessible, she/he must encrypt those information before sharing them.

9. Limitation of use |
|
The cost of accessing and browsing the RTE "Post'nGo" website is the sole responsibility of the user.
RTE reminds the user that the use of the application through mobile internet can be billed by her/his mobile network operator. It is up to the user to check these conditions. RTE declines any responsibility if the use of the application by the user leads to a billing from a third-party operator, not included in the present contract.
The full use of this application is limited to the scope of the European Union. As the application is exposed to the Internet, the mere access to the application page can result in a transfer of data outside the European Union, adequate nations and Safe Harbor.
RTE declines any responsibility towards the applicable laws outside the EU, especially the laws regarding the use of data encryption tools. The user accepts to comply with applicable local legislation.
RTE reserves the right to interrupt the service if it represents a danger to the security or stability of RTE infrastructure. Wherever possible, RTE will previously inform the user.
If necessary, RTE allows itself to interrupt the service in order to conduct a technical intervention to improve its functioning or for maintenance purpose.

10. Amendment to legal notice |

RTE reserves the right to amend the present legal information at any time. Therefore, the user undertakes to consult it regularly.
